The "Entire Contract" - More Like the Entire Headache

Let's talk contracts. Specifically, that one phrase that seems to haunt every single one: "The Entire Contract Includes All of the Following..." Followed by a laundry list longer than my grocery list on Thanksgiving. I get it. Lawyers want to be thorough. But here's a little secret (don't tell my lawyer): I think we can all agree on what isn't included, right?

I have an unpopular opinion. And maybe I'll get sued for this (kidding...mostly). But here goes: My therapist's bills are not included. I know, shocking! You sign a contract to, say, remodel your kitchen. Suddenly, you're knee-deep in color swatches, granite samples, and passive-aggressive remarks from your spouse about your "questionable" taste. Stress levels skyrocket. Therapist bills ensue. Nope. Not covered by the "Entire Contract." Trust me, I checked.

And while we're at it, let's talk about emotional distress. You know, that subtle feeling of panic that creeps in when you realize you've just committed yourself to something for the next five years. The feeling that maybe, just maybe, you didn't read all the fine print. (We've all been there, right?). That gnawing sensation that you might have accidentally signed away your firstborn child (metaphorically, of course… hopefully). Nope. Emotional distress? Definitely not included. Though, honestly, maybe it should be.

Let’s not forget my neighbor's dog, Barkzilla. He is DEFINITELY not included. No contract, even the most comprehensive, can anticipate the sheer volume of noise pollution emanating from that furry, four-legged menace. I guarantee you, no "Entire Contract" clause ever stipulated that I would be forced to endure daily 6 AM serenades of barking so loud it could shatter glass. It’s a breach of peace, I tell you! But alas, Barkzilla remains unaddressed.

Similarly, any promises made after three margaritas do not count. You know the drill. You're at a networking event. The chips and salsa are flowing. The margaritas are even more so. You find yourself shaking hands with a potential business partner. Suddenly, you're agreeing to collaborate on a revolutionary new app that will "disrupt the entire industry." The next morning, you wake up with a vague sense of dread and a faint recollection of promising to build the next Facebook. Was that part of the "Entire Contract"? I think not. Thank goodness.

And speaking of things that are definitely NOT included: my ability to understand legalese. I swear, contracts are written in a language only spoken fluently by lawyers and robots. Sentences that go on for miles, clauses that contradict each other, and enough "heretofores" and "whereases" to make Shakespeare blush. So, to clarify: my complete and utter confusion is not part of the deal. If the contract is incomprehensible to the average human, then I argue it’s missing vital components.

Oh, and while we're on the subject of honesty, let's just say that my willingness to pretend I understand what everyone is talking about in a business meeting is absolutely, positively not included. I might nod sagely. I might even throw in a well-placed "synergy" or "paradigm shift." But inside, I'm probably just thinking about what I'm having for dinner.

Ultimately, while I appreciate the thoroughness of the "Entire Contract," I think we can all agree that some things are simply implied. Like, for instance, the assumption that I will retain some semblance of sanity throughout the process. Or that I won't require therapy to cope with the stress. Or that Barkzilla will magically learn to bark more quietly.

So, the next time you see that dreaded phrase, "The Entire Contract Includes All of the Following...," just remember. Some things are best left unsaid. And some things are definitely not included. Especially my therapist's bills.
